A man has been sentenced to 26 years in prison and 20 strokes of the rotan by the Sessions Court for sexually assaulting his 12-year-old daughter on two occasions.
The incident was reported to the police when medical staff noticed that the victim, who was 22 weeks pregnant, was experiencing health issues. The 48-year-old man pleaded guilty to both charges in front of Judge Azreena Aziz.
The first assault took place in January at 10 a.m. in a bedroom of a house in a village in the Sipitang district. The second assault occurred in February at 12 noon in a farmhouse in the same village. Under Section 376 (3) of the Penal Code, each offense carries a maximum punishment of 30 years in prison and a minimum of 10 strokes. The court handed down a sentence of 13 years imprisonment and 10 strokes for each charge. In addition to his prison term, the man will also be placed under police supervision for two years after serving his sentence.
The court learned that a medical staff member at a health clinic in Sipitang noticed the victim's distressing symptoms, including coughing, vomiting, and abdominal pain, on July 21. The examination confirmed that she was 22 weeks pregnant. The staff member promptly reported the case to the police and referred the victim to the emergency unit at Sipitang Hospital for further assistance. Subsequent investigations revealed that the victim had been raped by her biological father on two occasions.
During the mitigation plea, the accused, who was unrepresented, appealed for leniency, citing the need to care for his ill elderly mother and support his family in the village. Deputy Public Prosecutor Dk Afiqah Alya Ak Johari urged the court to impose a severe punishment, given the gravity of the offense and the familial relationship between the abuser and the victim. It was highlighted that despite being married, the man succumbed to his lustful desires and committed heinous acts against his own daughter.
Ultimately, the court recognized the severity of the crimes committed and the detrimental impact on the victim's well-being. By handing down a significant sentence, it aims to serve both as a deterrent to potential perpetrators and as a measure of justice for the victim.
