
Kota Kinabalu: Two men, who were fighting in public early this month were fined RM300 or jailed three weeks each on Tuesday.
Businessman Alvin Wong, 26, and retiree Hisyam Abdullah, 60, pleaded guilty before Magistrate Lovely Natasha Charles to committing affray at Kedai Kopi Fan Hing, off Jalan Kolam, Foh Sang at 6.20am on Feb 12.
The prosecution told the court that on the said day a provocation ensued between the two, who barely knew each other, which led to a fight.
The prosecution said both men, who suffered minor injuries, lodged a separate police about the incident.
Wong and Hisyam were charged under Section 160 of the Penal Code which carries a jail term of up to six months or a fine of up to RM1,000 or both on conviction.
They requested a lenient sentence while the prosecution applied an adequate sentence.
In another case, a 29-year-old man was jailed three weeks for attempted theft.
Self-contractor Jamrey Jamil admitted to trying to steal four boxes of toothpaste and six bottles of shampoo, all worth RM118 at Mr DiY shop at Inanam new township at 5.38pm on Feb 24.
Prosecuting Officer Inspector Kelvan Elson Maik told the court that Jamrey’s act was caught on CCTV and was arrested while leaving the premises.
He was charged under Section 380 read with Section 511 of the Penal Code.
Counsel Lim Ming Zoong @ Lawrence applied for a lenient sentence on Jamrey and that he committed the offence as he owed a friend RM200 and that he wanted to sell the item for cash to pay his debt.
The court ordered Jamrey to serve the sentence from the date of his arrest.
