Fined for assaulting elderly man

Kota Kinabalu: The Magistrate’s Court here Friday fined a 31-year-old man RM2,000, in default seven months’ jail, for assaulting a 66-year-old man during an argument over a vehicle door.

Mohd Syafiq Mohd Salleh pleaded guilty before Magistrate Marilyn Kelvin to causing hurt to Tee Yan Tong at a car park in front of a pharmacy in Putatan at 8.18pm on March 23.

Syafiq was charged under Section 323 of the Penal Code, which provides for up to one year’s imprisonment, or a fine of up to RM2,000, or both upon conviction.

The prosecution told the court that the argument started after Syafiq became dissatisfied with Tee, who confronted him for opening his vehicle door forcefully and hitting Tee’s vehicle.

Syafiq then punched Tee repeatedly with both hands on the head, nose, face, right arm, right thumb and body, causing him to fall.

Tee suffered injuries including a wound above his left eyebrow, bruising and bleeding to his nose, an injury to his right cheek, scratches on his left neck and right arm, as well as pain on the left side of his head.

Unrepresented, Syafiq appealed for leniency, saying it was his first offence and claiming that Tee had provoked him by hurling insults.

He promised not to repeat the offence and asked the court to impose a fine.

Prosecuting Officer Inspector Dzulfamie Amrin applied for an appropriate sentence.
