Kota Kinabalu: A 55-year-old man was fined RM6,500, or jailed eight months by the Traffic Court, here, Friday for careless driving.
Brahim Guingona pleaded guilty before Magistrate Marilyn Kelvin to driving a Proton Wira carelessly towards other road users at Jalan Kionsom at about 9pm on July 1 this year.
Brahim was charged under Section 43(1) of the Road Transport Act 1987, which provides for a fine of between RM5,000 and RM10,000 and a jail term of up to 12 months upon conviction.
The court heard from the prosecution that a motorcyclist, Md Rasdam Azmie, was riding a Suzuki Rider from Taman Inanam Laut towards Kionsom when the accident occurred.
Upon reaching the junction at Inanam Jaya housing area, Kionsom, the motorcyclist was travelling along the main road when Brahim, driving the Proton Wira, suddenly emerged from a junction on the left.
The collision damaged the front of the motorcycle and the front right side of the Proton Wira.
Investigations found that the accident was caused by Brahim’s negligence in failing to give way to the motorcycle travelling on the main road before emerging from the junction.
The court also ordered Brahim’s driving licence to be endorsed with the conviction.
