
Kota Kinabalu: Two Indonesians who had overstayed 10 and 17 years after their documents expired, were jailed 12 months each.
Nikolas Maran, 56, and Basri Hassan, 32, pleaded guilty separately before Sessions Court Judge Hurman Hussain, to the charge against them.
Nikolas was found to have overstayed in the State for 17 years and seven months, at 5.30pm on Feb 17 this year at the Tenom town after his Temporary Work Visit pass expired on July 7, 2007.
Meanwhile, Basri had overstayed for 10 years and one month after his Social Visit pass had expired on Dec 21, 2014.
He was arrested on Feb 18 this year at 3.40pm at house in Kg Bengkongan, Kota Marudu.
The offence under Section 15(1)(c) of the Immigration Act carries a jail term of up to five years, or a minimum fine of RM12,000, or both, on conviction.
In their mitigation, they asked for leniency saying that they have family to look after.
After serving the jail sentence, both of them were ordered to be referred to the Immigration Department for further action.
The court ordered the duo to serve the jail sentence from the date of their arrests.
In another case, a Filipina was sent to prison for 12 months for entering the State illegally and having fake endorsement on her special pass.
Nurhima Malani Ibnu admitted to two counts against her.
On the first count, she was jailed six months for entering the State without any document.
On the second count, Nurhima was sentenced to another six months’ jail for having fake endorsement on her document dated Jan 3 and March 10 this year.
She was detained at 2.50pm on March 20 this year at the Immigration Operation Office in Kota Kinabalu International Airport, here.
