Tengku Kamarolhisham, a former THP Bina deputy GM, pleaded not guilty to three charges of abetting CBT involving RM72,000 in contractor penalties.
KUALA LUMPUR: A former deputy general manager of THP Bina Sdn Bhd today pleaded not guilty in the Sessions Court here to three charges of abetting criminal breach of trust (CBT) involving RM72,000.
Tengku Kamarolhisham Tengku Kamaruddin, 55, is accused of abetting former THP Bina Safety and Health Manager Nasahruddin Ahmad in misappropriating money collected as penalties from contractor Fourth Wave Sdn Bhd.
The first charge involves RM22,400, allegedly misappropriated between April 26 and Dec 17, 2013, at the Islamic Complex in Precinct 3, Putrajaya.
The second charge involves RM25,600, allegedly misappropriated between Feb 6 and Dec 2, 2014, while the third charge involves RM24,000, allegedly misappropriated between Feb 16 and Aug 12, 2015.
According to the charges, Nasahruddin, who was entrusted with control of the money in his capacity as THP Bina’s Safety and Health Manager, allegedly committed CBT by dishonestly misappropriating the funds and depositing them into his personal bank account.
Tengku Kamarolhisham is accused of intentionally directing Nasahruddin to carry out the acts.
The charges were framed under Section 109 of the Penal Code, read together with Section 409 of the same law, which carries a prison sentence of between two and 20 years, whipping and a possible fine upon conviction.
The prosecution proposed bail of RM70,000 with one surety, subject to several conditions, including that Tengku Kamarolhisham report to the Malaysian Anti-Corruption Commission (MACC) during the first week of every month, surrender his passport to the court until the case is concluded, and refrain from contacting or interfering with witnesses.
However, Judge Azura Alwi reduced the bail to RM45,000 and waived the requirement for him to report to the MACC.
The other conditions, including surrendering his passport and refraining from contacting or interfering with witnesses, remained.
The court fixed Oct 5 for mention.
THP Bina Sdn Bhd is a wholly owned subsidiary of TH Properties Sdn Bhd, which is itself a subsidiary of Lembaga Tabung Haji. The company focuses on construction and project management.
