Nasahruddin Ahmad, a former THP Bina manager, claims trial to three CBT charges involving RM72,000 allegedly deposited into his personal bank account.
KUALA LUMPUR: A former Safety and Health Manager of THP Bina Sdn Bhd today claimed trial at the Sessions Court here to three charges of criminal breach of trust (CBT) involving RM72,000.
Nasahruddin Ahmad pleaded not guilty after the charges were read before Judge Rosli Ahmad.
Lawyer Naqib Aiman represented Nasahruddin.
The prosecution initially proposed bail of RM70,000, but the court granted bail at RM50,000 with one surety for all three charges.
The court also ordered Nasahruddin to report to the Malaysian Anti-Corruption Commission (MACC) office in Putrajaya once a month on the first day of each month, surrender his passport to the court until the case is concluded, and refrain from contacting or interfering with prosecution witnesses.
The first charge involves RM22,400, which he allegedly misappropriated between April 26 and Dec 17, 2013.
The second charge involves RM25,600, allegedly misappropriated between Feb 6 and Dec 2, 2014, while the third charge involves RM24,000, allegedly misappropriated between Feb 16 and Aug 12, 2015.
According to the charges, Nasahruddin, who was then the Safety and Health Manager of THP Bina, had been entrusted with money collected as penalties from contractor Fourth Wave Sdn Bhd for a development project at the Putrajaya Islamic Complex, Precinct 3.
He was accused of dishonestly misappropriating the funds by depositing them into his personal bank account.
The charges were framed under Section 409 of the Penal Code, which provides for a prison sentence of between two and 20 years, whipping and a fine upon conviction.
The court fixed Oct 5 for mention.
THP Bina Sdn Bhd is a wholly owned subsidiary of TH Properties Sdn Bhd, which is itself a subsidiary of Lembaga Tabung Haji. The company focuses on construction and project management.
