PETALING JAYA: The government is proposing amendments to the Road Transport Act 1987 to introduce a mechanism requiring convicted offenders to compensate victims or their next of kin in cases involving deaths or serious injuries.
The Transport Ministry (MOT) said the proposed mechanism aims to safeguard the welfare of victims and families affected by road accidents, particularly those caused by drivers under the influence of alcohol or drugs.

It added that the government was considering empowering courts to order convicted offenders to pay compensation based on the circumstances and merits of each case.
“From a policy standpoint, the government has considered that compensation amounts should not be fixed administratively, but determined by the courts.
“The amount would take into account factors such as the severity of injuries or death, losses suffered and the offender’s ability to pay,” it said in a written reply to the Dewan Rakyat.
The ministry was responding to Shaharizukirnain Abd Kadir (PAS-Setiu), who asked about the outcome of its discussions with the Attorney-General’s Chambers on implementing compensation or diyat payments for the families of victims killed in accidents involving drink-driving.
MOT said the government was also examining offenders’ financial capacity, payment methods and enforcement measures in cases where they lacked sufficient assets or financial means to fulfil compensation orders.
“This is important to ensure that the compensation order introduced not only has a legal basis but also genuinely benefits victims and their next of kin,” it said.
The ministry added that it would continue working with relevant agencies and ministries to refine the mechanism before finalising and tabling the proposed amendments in Parliament.
“The government remains committed to delivering justice to victims and their next of kin.
“Justice for victims’ families should not end with the punishment imposed on offenders, but must also take into account the economic and social impact on families following the loss of a loved one or their source of income.”
