Group housing societies in Haryana likely to come under Right to Service Act

In view of the alleged harassment by the cooperative group housing societies on account of unnecessary delays, repeated objections and harassment in the transfer of share certificates after sale, the Right to Service Commission has wrote to Haryana government to bring the service related to the works of these societies under ambit of the Right to Service Act for speedy and timely disposal of cases and thus to save people from harassment.

In a letter to the Principal Secretary, Cooperation Department, the Commission (a copy is with The Tribune) stated that it had received a representation from Pawan Kumar Bansal, President of Gurugram-based NGO Citizens for Responsibility, Accountability and Transparency, who highlighted alleged harassment and corrupt practices in the works and thus sought notification of the service under the Right to Service framework.

The Commission observed that residents who are members of Societies often face unnecessary delays, repeated objections and harassment in matters related to the transfer of share certificates after sale, succession or nomination. There is no prescribed timeline for the disposal of such cases as of now, leading to inconvenience and a lack of accountability.

According to the Commission, transfer of share certificates is directly linked with ownership and membership rights as well as enjoyment of residential property in Cooperative Group Housing Societies. It pointed out that delays in such transfers adversely affect mutation, sale, inheritance, maintenance records and other related matters.

Citing provisions of Section 17(1) of the Haryana Right to Service Act, 2014, the Commission said it is empowered to recommend additional services to be notified under the Act for ensuring better delivery of public services, thus recommended be formally notified under the Act with clearly defined timelines for disposal of applications.

The proposed service framework may include receipt of applications, scrutiny of documents, removal of objections, approval or rejection by the competent authority and issuance or endorsement of transferred share certificates, it stated.

Bansal said it will benefit a lack of residents living in cooperative group housing societies across the state by introducing greater transparency, accountability and efficiency in the transfer process if these services are brought under the RTS ambit.

TC Gupta, chairperson of the Commission, confirmed to The Tribune that, acting on an application, he had written to the state government recommending that these services under the Act, as it affects lakhs of residents across Haryana, especially in towns like Gurugram, Faridabad and Panchkula.

Gupta, informed that there are 802 services related to services in the government departments, incentive schemes of the government and grievances under the ambit of the Act. “I wish that the appropriate authorities at the state government would take action on my recommendation in about ten days,” he said.
