SANDAKAN: A 31-year-old security guard was charged with killing his mother-in-law early this month.

However, no plea was taken from Totoh Amin after the charge was read to him before Court Registrar Siti Aisyah Umar Baki, on Thursday.

Totoh is accused of killing Norina Sapuri, 58, between 9am and 4.40pm on March 2 this year at the route to a squatter housing area in Bukit Batu ½, here.

The offence under Section 302 of the Penal Code carries a sentence of either a death penalty or imprisonment between 30 and 40 years, and if not sentenced to death, shall be punished with whipping of not less than 12 strokes, on conviction.

No bail was offered to Totoh as the charge against him has no provision for bail.

The court set Apr 10 this year for mention pending the post-mortem and chemistry’s reports.

ASP Zamri Zakaria appeared for the prosecution while Totoh was not represented.

In KOTA KINABALU, a 20-year-old factory worker, who befriended an underaged student through social media, was charged with raping her.

Fransiskus Xaferius Agusto claimed trial before Sessions Court Judge Amir Shah Amir Hassan, to the charge against him on Thursday.

Fransiskus is accused of raping the 15-year and 11-month-old girl at 11am on Sept 1, 2024 in a hotel room in Tuaran.

He was charged under Section 376(1) of the Penal Code which provides for a jail term of up to 20 years, and whipping, on conviction.

The court set Apr 15 this year and offered bail of RM6,000 in two local sureties to Fransiskus pending the disposal of his case.

Fransiskus was also ordered to report to police station once a month and his passport to be kept by the court.

Earlier, counsel Bartholomew Jinggulam who represented Fransiskus, asked for bail to be granted to him saying that Fransiskus has no relationship with the alleged victim.

Deputy Public Prosecutor Fazriel Fardiansyah appeared for the prosecution.

Meanwhile, a 53-year-old driver who was trusted to send and fetch two minors to a kindergarten, was charged with touching the kids’ private parts, respectively.

Rusli Japar pleaded guilty before Sessions Court Judge Amir Shah Amir Hassan, to three charges against him on Thursday.

However, Rusli’s sentencing was deferred to March 25 as the court was informed by the prosecution that the facts of the case were not ready and there were some documents needed to be checked.

Pending the date, Rusli was ordered remanded further following the objection by the prosecution.

Earlier, the prosecution objected bail on the grounds that Rusli is living in the same area with the alleged victims.

On the first count, Rusli is accused of committing physical sexual harassment against the five-year-old girl by touching her private parts between March and December 2024 inside a car parked in a village in Tuaran.

On the second count, he allegedly repeated the offence against the same girl at a house in the same village in Tuaran.

On the third count, Rusli is accused of repeating the same offence against another five-year-old girl also by touching her private parts in 2022 inside a car also parked in the same village in Tuaran.

The offence under Section 14(a) of the Sexual Offences Against Children Act 2017 provides for a jail term of up to 20 years and whipping, on conviction.
