Guilty plea for assaulting wife is rejected

Kota Kinabalu: A 50-year-old man’s guilty plea for assaulting his wife plea was rejected by the Magistrate’s Court, Tuesday.

Magistrate Wan Farrah Farriza Wan Ghazali rejected Julhari Osman’s plea as he was indecisive about his plea after the charge was read to him.

Initially, Julhari admitted to the charge, but later, when asked again, he said “I don’t really admit.”

Julhari was accused of assaulting his wife in a rented room, here at 9pm on Aug 29, last year.

Read more He was charged under Section 323 of the Penal Code which carries a jail term of up to one year or fine of up to RM2,000 or both, on conviction.

Deputy Public Prosecutor Batrisyia Mohd Khusri proposed a bail of RM6,000, with two local sureties.

Unrepresented, Julhari requested a lower bail amount as he is currently unemployed and sick.

The court allowed Julhari to be released on a bail of RM2,000 with two local sureties and fixed March 14 for pre trial-case management.

In another court, a 30-year-old man who fraudulently had RM13,000 deposited into his bank account was fined RM100 or a day in jail.

Awie Abdul Hassan pleaded guilty before Magistrate Stephanie Sherron Abbie to having the money belonging to Edward in his Maybank account, which he failed to give a satisfactory explanation of how he obtained on Jan 16 to March 27, last year.

The offence under Section 22A (1) of the Minor Offences Ordinance, provides a fine of up to RM100 or up to three months jail or both, on conviction.

Unrepresented, Awie requested a lenient fine as his bank account was used by his friend to sell cars.
