
Kota Kinabalu: A 41-year-old was jailed five years and ordered given a stroke of cane for repeatedly taking syabu.
Sessions Court Judge Hurman Hussain handed the sentence to Azwin Ahmad after he pleaded guilty, Tuesday.
He was found taking the drug after his urine was tested positive at the police station here on November 18, 2024 and he has several conviction records for taking drugs.
The offence under Section 15(1)(a) Dangerous Drugs Act (DDA) 1952 is punishable under Section 39C(1)(b) DDA 1952, which carries a jail term up to five to seven years and whipping not less than three times, on conviction.
The court ordered Azwin to serve the jail sentence from the date of his arrest.
After serving the sentence, the court also ordered Azwin to be placed under police supervision for two years.
Azwin, who was not represented, requested a lenient sentence as he had recently undergone intestinal surgery and has diabetes.
Deputy Public Prosecutor (DPP) Fazriel Fardiansyah applied for a deterrent sentence as Azwin was a habitual offender.
