Kota Kinabalu: A 36-year-old lorry driver who had in his possession a machete in public without a permit, was sentenced to five years’ jail and ordered to get a stroke of the cane.
Avckson Jiun @ Justin changed his plea and pleaded guilty before Sessions Court Judge Ummu Khaltom Abdul Samad, to the charge against him on Monday.
He was found having the 17-inch machete at 2am on Aug 11 this year by the roadside in Kg Suang Parai, near here.
The offence, under Section 6(1) of the Corrosive, Explosive Substances and Offensive Weapons Act 1958, carries a jail term of between five and 10 years, and whipping on conviction.
The court ordered Avckson to serve the jail sentence from the date of his arrest on Aug 11 this year.
During mitigation, Avckson who was not represented, asked for leniency and that the sentence to run from the date of his arrest.
However, Deputy Public Prosecutor Fauzi Acho prayed for a deterrent sentence on the grounds that it was a serious offence as Avckson had carried weapon in public without permit.
The court heard that Avckson was arrested by the police during the Ops Bersepadu carried out at the Snap Check area in Kg Suang Parai.
The police had arrested Avckson who acted in suspicious manner, tried to run away to avoid the snap check route.
Upon checking on Avckson’s body, the police found the 17-inch machete which kept inside his sling bag and he has no permit to having the weapon in public place.
In another case, an illegal immigrant was sentenced to four months’ jail for entering the State illegally.
Sessions Court Judge Azreena Aziz meted out the sentence to Loyloy Mirontos who admitted to the charge.
Loyloy was arrested on Sept 9 this year at Ranau after failing to produce his identification document.
After serving the jail sentence, Loyloy was ordered to be referred to the Immigration Department for his biometric data to be recorded before deportation.
