
Kota Kinabalu: A 25-year-old foreign man was sentenced to 12 months’ jail on Thursday for keeping a stolen handphone.
Malik Tasim pleaded guilty before Magistrate Stephanie Sherron Abbie to having the gadget belonging to one Norsiah Asmad at 5.15pm on June 9 at Putatan.
He was charged under Section 411 of the Penal Code which provides for a jail term of up to seven years or a fine or both, on conviction.
Based on the facts of the case presented by the prosecution, the complainant lodged a police report that her handphone, which was charged at the corner of her house in Putatan, went missing at 4.40am on June 9.
Malik, who was not represented, requested leniency.
The court ordered Malik, who has no valid identification document, to be referred to the Immigration Department after serving the jail term.
In another case, a 35-year-old man was charged with two counts of disposing of stolen properties.
Norbert Liau Chee Min was accused of disposing of a stolen laptop and stolen television respectively at a house along Jalan Taman Kionsom, Inanam around June between 11.59pm and 12.01am.
He pleaded not guilty to both charges under Section 414 of the Penal Code.
Inspector Suzie @ Stephanie Kupit, prosecuting, proposed bail at RM6,000 on each charge.
Duty counsel Lim Ming Zoong @ Lawrence, representing Liau, applied for a lower bail sum on the grounds that Liau was doing online business and married with two children.
The court set July 18 and July 20 for mention of the cases and released Liau on a bail of RM2,000 in two sureties on each charge.
Meanwhile, Liau was also fined RM3,000 or eight months’ jail after he admitted to having 0.12gm of syabu.
Having syabu under Section 12 (2) of the Dangerous Drugs Act 1952 provides for a fine of up to RM100,000 or up to five years jail, or both, on conviction.
