Having stolen property: Man gets 16 months

Kota Kinabalu: A 34-year-old man was sentenced to a total of 16 months’ jail by the Magistrate’s Court here on two counts of having stolen property.

Jimmy Hon Jin Chyong pleaded guilty before Magistrate Marilyn Kelvin to committing the offences on Feb 17, this year at 11.30am at Block L, Lorong Universiti 1.

On the first count, Hon was sentenced to eight months’ jail for keeping a Perodua Axia’s tyre along with its rim.

On the second count, he received another eight-month jail term for having another Perodua Axia’s tyre with its rim.

Each charge, under Section 411 of the Penal Code, carries a jail term of between six months and five years, along with the possibility of a fine on conviction.

The facts of the case presented by the prosecution stated that the first incident was reported on Feb 15, this year, when complainant Roland Yee discovered that a tyre with its rim, installed at the rear of a Perodua Axia, was missing from the parking area of Inanam Mall, Inanam.

In the second charge, complainant Hairrychael Julieto lodged a police report on Feb 14, stating that a Perodua Axia tyre together with its rim, valued at RM450, had gone missing from the same parking area.

Hon was ordered to serve the imprisonment sentence from the date of his arrest.

Meanwhile, a 41-year-old man was sentenced to eight months’ jail for theft.

Mohd Sahfie Mat Zain admitted to stealing 42 iron rods belonging to Sinkong Fleet JV Sdn Bhd on March 4, this year, at 10.15am, at the roadside of Pan Borneo WP08 construction site, Bukit Hap Seng, Jalan Tuaran, Manggatal.

The charge, under Section 379 of the Penal Code, carries a jail term of up to seven years or fine, or both, on conviction.

The facts of the case, as presented by the prosecution, stated that Sahfie was seen by the site’s workers taking the iron rods and hiding them in nearby bushes.

The workers attempted to retrieve the iron rods from Sahfie, but he refused, prompting the complainant to contact the police, who arrested him.

In the same court, a man was fined RM2,600 or six months for disposing of stolen household and personal care products. Robenlee Balang Daring pleaded guilty to committing the offence on three boxes of shampoo, two boxes of air fresheners and four boxes of fabric softeners on March 3, between 3am and 5am, at the warehouse of the Kim Teck Cheong Consolidated Borneo, Jalan Kolombong, near here.

The charge was framed under Section 414 of the Penal Code which carries a jail term of up to seven years or fine, or both, on conviction.
