Fined for operating entertainment outlet after permitted hours

Kota Kinabalu: A 25-year-old man was fined RM6,500 or eight months jail on Friday by the Magistrate’s Court here for operating an entertainment outlet premises beyond the permitted time.

Jasri Yunus, 25, pleaded guilty before Magistrate Marilyn Kelvin on Friday to committing the offence at the Barong, Penampang Point, Mile 4, Jalan Penampang, Penampang, on Dec 8, 2024, at 2.55am.

The charge stated that Jasri had operated the premises beyond the stipulated time of 2 am as stated in the licence issued to the premises.

The fact of the case presented by the prosecution, stated that formed the court that a police team raided the place and found it still operating with loud music with customers inside.

Jasri had committed an offence under Section 4(1) of the Public Entertainment Ordinance 1958 which is punishable under Section 11 of the same Ordinance that provides for a fine of up to RM5,000 or up to one year or both on conviction.

In another case, a 25-year-old waiter was charged with molesting an 18-year-old woman.

Muhd Nur Ezannee Mokmin pleaded not guilty before Magistrate Wan Farrah Farriza Wan Ghazali, to committing the offence against the woman on Feb 19, this year, at 7pm, at a restaurant in Putatan.

The charge is framed under Section 354 of the Penal Code.

The court set May 13 for mention and released the accused on a bail of RM3,000 in two sureties.

Meanwhile, an undocumented man claimed trial to a theft charge.

Amir Samma, 20, who appeared before Magistrate Marilyn, is accused of stealing a fish container belonging to Desa Kemagi Seafood & Grill, on Feb 21, this year, at 5am, at the Harbour City, here.

He was charged under Section 379 of the Penal Code.

The court set April 16 for mention and ordered the accused to be further remanded.

Deputy Public Prosecutor (DPP) Muhammad Haikal Hazwan Md Yatin and Inspector Yusdi Basri prosecuted.
