Hurting wife: Man jailed, fined

Kota Kinabalu: A 38-year-old man was jailed 16 months and fined RM2,000 or four months’ jail, Thursday, for assaulting his wife by throwing a tablet computer at her head.

Construction labourer Mohd Affendi Ramli pleaded guilty before Magistrate Jessica Ombou Kakayun to causing hurt to his 27-year-old wife at 2.30pm on Sept 9 in a rented room at Taman Pasir Putih shoplot in Putatan.

The court was informed by the prosecution that the wife had lodged a police report on the said day claiming that she was hit by her husband and suffered a head injury as a result of the tablet being thrown at her.

Police investigations revealed that the wife got the injury as a result of being hit by a tab thrown by Affendi during the fight between them.

Affendi was charged under Section 323 of the Penal Code read together with Section 326A of the same Code.

Section 323 carries a jail term of up to one year or a fine of up to RM2,000, or both, on conviction while Section 326A states that whoever causes hurt to his spouse or former spouse, a child, a disabled adult, or other family members and commits an offence under Section 323, 324, 325, 326, 334 or 335 shall be punished with imprisonment for a term of twice as long as the maximum term for which he would be liable to on conviction for that offence.

Unrepresented, Affendi requested leniency by saying that he supported his two children and wife.

Inspector Albert Basiri prosecuting applied for a deterrent sentence.

Meanwhile, an assistant clerk was fined RM1,000 or one-week jail for assaulting a man.

John Chong, 21, admitted to committing the offence against one George Wong at 1.40pm on Oct 7 at a teacher’s quarters here.

Unrepresented, Chong in between sobs requested leniency and asked for a chance to be a better person while the prosecution applied for an adequate sentence.

He was charged under 323 of the Penal Code which carries a jail term of up to a year or fine of up to RM2,000, or both, on conviction.

In another case, a 28-year-old man was jailed one day and fined RM10,000 or two months’ jail for drink driving.

Juandi Moses pleaded guilty before Magistrate Stephanie Sherron Abbie to committing the offence at 1.45am on May 22, this year at Jalan Bundusan in front of the McDonald’s restaurant, in Penampang.

He was charged under Section 45A(1) of the Road Transport Act 1987 provides for a fine of between RM1,000 and RM6,000 or jail of up to 12 months on conviction.
