Kota Kinabalu: A 51-year-old director of a travel agency was fined RM2,000 or jailed six months by the Magistrate’s Court, here, for failing to comply with a Consumer Claims Tribunal award requiring the company to refund RM14,288.40 to a claimant.
Jafni Hashim pleaded guilty before Magistrate Marilyn Kelvin to the charge.
Jafni, as director of Kembara Ziarah Travel & Tours Sdn Bhd, was charged with failing to comply with an award issued by the Tribunal for Consumer Claims Malaysia, here, on Aug 21, 2023.
The award ordered the company to refund RM14,288.40 to the claimant, Norazah Ramlee, within 14 days from the date of the award.
However, the company failed to comply with the order.
The offence was committed on Nov 9, 2023.
Jafni was charged under Section 117(1) of the Consumer Protection Act 1999, which carries a fine of up to RM10,000 or a jail term of up to two years, or both, on conviction.
Prosecuting Officer Malai Rosidi Malai Muhamad from the Ministry of Domestic Trade and Cost of Living (KPDN) prosecuted.
Meanwhile, two men claimed trial to a charge of assisting in the disposal of stolen property.
Andy Lim Vui Lun, 34, and Rafianzie Ronnie, 31, pleaded not guilty to jointly assisting in the disposal of a stolen Perodua Myvi rim at a premises in Kg Buit Hill, here, at 4.15pm on July 31.
They were charged under Section 414 of the Penal Code, read together with Section 34 of the same Code.
The court fixed Oct 8 for pre-trial case management and released each accused on RM1,400 bail in two sureties.
They were also ordered to report to the investigating officer once a month.
