Illegal jailed for trespassing into woman tourist’s room

SEMPORNA: An illegal immigrant who trespassed into the room of a woman tourist from China at a resort in Semporna was jailed two years by the Magistrate’s Court here on Oct 7.

Semporna District Police Chief Supt Tan Hiap Wah said the accused, identified as Amir Kahal, committed the offence by entering Room 207 at the resort along Jalan Kemiri at 3am on Sept 19.

He said the man was charged under Section 448 of the Penal Code and would be handed over to the Immigration Department after completing his prison sentence.

He, however, added that investigations against the accused under Section 354 of the Penal Code were still ongoing, pending the completion of a chemical analysis report.

“Once the report is available, police will seek further instructions from the Deputy Public Prosecutor on the appropriate charges,” he said in a statement, Saturday.

Tan said the accused was also scheduled to be charged under Section 6(1)(c) of the Immigration Act 1959/63 on Nov 5 for allegedly entering or remaining in Malaysia without a valid pass or permit.

He said police would take firm action against anyone found violating the law, including employers who hired undocumented migrants or foreign workers without valid permits.

Legal action could also be taken against owners, tenants, occupants or individuals responsible for managing and controlling premises if they allowed foreigners without valid documents to reside or remain there, he added.

Tan urged the public, particularly employers and property owners, to comply with the law and refrain from harbouring or allowing undocumented migrants to stay in their premises unlawfully.

He also called on anyone with information about criminal activities or the presence of undocumented migrants to report to the police for further action.
