Kota Kinabalu: An Indonesian was jailed six months for staying in the State after her temporary work visit pass had expired for 10 months and 28 days.
Sessions Court Judge Hurman Hussain meted out the sentence to Kartika Lito Kleden, who pleaded guilty to the charge against her.
Kartika was found overstaying in the State after her work visit pass had been expired on March 28, 2024.
She was arrested at 11.40pm on Feb 26 this year at Kg Nosoob, Penampang.
The offence under Section 15(1)(c) of the Immigration Act 1959/63 carries a fine of at least RM10,000, or a jail term of up to five years, or both, on conviction.
Prosecuting Officer Mohd Hairul Bona appeared for the prosecution.
In the same court, 14 illegal immigrants were jailed and fined for entering the State illegally.
They were Nurisa Karim, Yasinta Kesibele Herin, Al Dumil Al Makin, Asrie Halul, Habir Sajid, Haidir Sajid, Ismail Sani, Leo Awayan, Marjiya Sajit, Marma Kasim, Nasil Wahir, Sajil Amil Karim, Telbela Nopisiun and Ridzwan Ben Ben.
All of them admitted to the charge against them, respectively.
Thirteen of them were jailed four months each, while Nurisa was fined RM3,000 or jailed four months. She paid the fine.
The offence under Section 6(1)(c) of the Immigration Act 1959/1963 provides for a jail term of up to five years, or a fine of up to RM10,000 and whipping, on conviction.
They were arrested separately in Penampang and Menggatal in Feb, this year after failing to produce their identification documents during an operation carried out by the Immigration Department.
The court ordered all the illegals to serve the jail sentence from the date of their arrests and referred to the Immigration Department for further action after completing the jail sentence.
