
PETALING JAYA: UEM Sunrise Bhd has been named in a lawsuit by Jana DCS Sdn Bhd over the alleged termination of district cooling agreements dating back to 2012 involving assets in Puteri Harbour, Johor.
The property developer said Jana filed a writ of summons and statement of claim at the High Court in Kuala Lumpur on Aug 11, naming UEM Sunrise as the seventh of 13 defendants.
According to UEM Sunrise, Jana’s claims include the company’s alleged involvement in the termination of historical district cooling agreements entered into between Jana and three other defendants in 2012.
The agreements involved Puteri Harbour assets that are now owned by UEM Sunrise.
UEM Sunrise said it is reviewing the claims with its external legal counsel and will take the necessary steps to protect its interests.
“At this juncture, the financial impact, if any, cannot be determined,” it said in a filing with Bursa Malaysia today.
The latest legal action comes against the backdrop of a long-running dispute involving Jana and several companies linked to Puteri Harbour.
Khazanah Nasional Bhd’s financial statements previously disclosed that Jana had filed claims totalling RM248.3 million against TAR PH Sdn Bhd, TAR PH Family Entertainment Sdn Bhd and PH Marina Boulevard Sdn Bhd over the alleged unlawful termination of three agreements for the implementation of a district cooling system dated May 30, 2012.
One of those disputes resulted in an arbitral award of RM89.26 million in Jana’s favour against TAR PH over the wrongful termination of a 2012 agreement to supply cooling loads for the Puteri Harbour Hotel. The High Court later dismissed an attempt to set aside the award.
TAR PH was subsequently wound up by the High Court in February 2025 over an unpaid debt of almost RM95 million owed to Jana.
It was not immediately clear from UEM Sunrise’s announcement whether the latest suit forms part of, or is directly related to, the earlier disputes involving the three Puteri Harbour companies.
