Johor Bahru authorities from the Johor Islamic Religious Department (JAINJ) recently apprehended a man in his 60s and a woman in her 20s for khalwat following a public tip-off. The incident occurred at a double-storey residence in the city, where enforcement officers arrived at 2:15 AM and, after knocking for ten minutes, were met by the elderly homeowner.
Upon entering, officers discovered the young woman resting on a couch, prompting immediate questioning. Investigations revealed that the man is a single grandfather, while the woman hails from a northern state in Peninsular Malaysia and is currently employed in Johor Bahru.
The man defended his actions, asserting that the woman was staying at his house to care for him due to his health condition. He explained that he sometimes experiences fainting spells and temporary vision problems, leaving him anxious about being alone. The woman, he added, was simply assisting him with daily tasks and providing companionship.
JAINJ enforcement, however, noted that regardless of his explanation, the presence of the two adults alone in the residence constituted khalwat under the law. Officers confirmed that no other individuals were in the house, making the situation clear-cut from a legal perspective.
Authorities also inquired whether the couple had intentions of formalizing their relationship through marriage, which could have provided a lawful context for cohabitation. The man admitted that marriage was planned, but both parties hesitated to proceed immediately due to concerns over societal perceptions related to their significant age difference.
A spokesperson for JAINJ remarked that while personal circumstances might explain the arrangement, the law regarding khalwat is strict, emphasizing that religious and societal norms must be upheld regardless of individual claims. The department highlighted that enforcement actions aim to maintain public morality and compliance with Shariah regulations.
The incident sparked discussions about the boundaries of care and companionship versus legal compliance, particularly in cases involving substantial age gaps and familial or health-related dependencies.
