SHAH ALAM: Any move to shorten or terminate Datuk Seri Mohd Shuhaily Mohd Zain’s tenure as Malaysian Border Control and Protection Agency (AKPS) director-general requires legal advice from the Attorney-General’s Chambers (AGC) and the consent of the Yang di-Pertuan Agong, Inspector-General of Police Tan Sri Mohd Khalid Ismail said.
He said the matter had been referred to the AGC for legal advice and the Police Force Commission (SPP) for further action, as Mohd Shuhaily’s two-year assignment to AKPS was based on a formal secondment arrangement from the Royal Malaysia Police (PDRM) that had received royal consent.

“We are referring this matter to the AGC because Datuk Seri Mohd Shuhaily’s assignment to AKPS is for a period of two years.
“It is like a contract, and this contract was granted the consent of the King.
“If anything arises involving suspension from duty or similar matters, the action to be taken will depend on the AGC’s advice. However, any decision involving termination of the contract and related matters must be submitted to the Yang di-Pertuan Agong for consent,” he told reporters here today.
Mohd Khalid was speaking after the National Conference on Bureaucratic Red Tape Reform 2026, organised by the Malaysia Productivity Corporation (MPC).
He said legal advice was necessary to ensure that any action involving Mohd Shuhaily complied with the terms of his secondment and the requirement for royal consent.
He reiterated that any decision to shorten Mohd Shuhaily’s tenure would also have to be submitted to the King for consent.
Once the legal review and process of obtaining royal consent are completed, the matter will be referred back to PDRM for further action, he said.
Mohd Khalid said Mohd Shuhaily remained a serving police officer despite his assignment to AKPS.
“Once he returns, I may provide a more detailed explanation of the matters that need to be addressed and the follow-up action to be taken, God willing,” he said.
