Lawyers representing Tun Daim Zainuddin have criticized Tan Sri Azam Baki, the head of the Malaysian Anti-Corruption Commission (MACC), for repeatedly commenting on Daim's ongoing case despite a warning from the presiding judge to refrain from doing so.

In a statement released today, Daim's legal team argued that Azam Baki's remarks regarding Daim's alleged assets are prejudicial and constitute a violation of the principle of sub judice. They pointed out that the judge overseeing Daim's case had explicitly instructed all parties to refrain from making any statements that could influence the proceedings.

Azam Baki's recent statement implying that investigators may summon Daim for questioning regarding additional undeclared assets was cited as the latest example of his disregard for the court's instructions. Daim's lawyers emphasized that such comments create the perception of guilt before a fair trial has taken place.

Former Attorney General Tan Sri Tommy Thomas is representing Daim in the case, in which the 86-year-old has been charged with failure to declare his assets under Section 36(2) of the MACC Act.

The investigation into Daim's financial affairs by the MACC began following the release of the Pandora Papers in 2021, which implicated him in offshore financial activities. Subsequent leaks have linked Daim and his family to offshore business entities and trusts worth millions of ringgit.

Of particular interest are revelations regarding Daim's sons, Muhammed Amir Zainuddin Daim and Muhammed Amin Zainuddin Daim, who were named as owners of a British Virgin Islands firm when they were children. By their early twenties, they had become owners of multiple offshore companies, including one holding London properties valued at millions of pounds.

In light of these developments, Daim's legal team has called for respect for the legal process and the principle of fair trial, urging Azam Baki and the MACC to refrain from further public commentary on the case. They argue that such statements not only undermine the integrity of the judicial system but also violate Daim's constitutional rights.
