Communications Minister Fahmi Fadzil has refuted claims made by Perikatan Nasional (PN) chairman Tan Sri Muhyiddin Yassin regarding the recent decision of the Federal Court to nullify 16 provisions of offences under the Kelantan Syariah Criminal Code (1) Enactment 2019. Fahmi asserted that Muhyiddin's statement is inaccurate and constitutes spreading false information.

In response to Muhyiddin's assertions that certain actions contrary to Islamic law would no longer be considered offences in Kelantan following the court ruling, Fahmi denounced the claims as misinformation. He, being the spokesperson for the unity government, made these remarks on his X account today.

The Federal Court's decision, rendered with an 8-1 majority vote, declared 16 provisions of offences under the Kelantan Syariah Criminal Code Enactment (1) 2019 null and void. Chief Justice Tun Tengku Maimun Tuan Mat, leading a panel of nine judges, delivered the verdict following an application by Nik Elin Zurina Nik Abdul Rashid and her daughter, Tengku Yasmin Nastasha Abdul Rahman, both hailing from Kelantan. They sought to challenge the constitutionality and legality of 18 provisions of offences under the said enactment.

The ruling signifies a significant development in the legal landscape of Kelantan's Islamic criminal law. However, Fahmi's rebuttal of Muhyiddin's claims underscores the importance of accurate information dissemination, particularly in matters concerning legal decisions and their implications.

Furthermore, this episode highlights the ongoing debate and scrutiny surrounding the implementation and interpretation of Islamic laws in Malaysian states, particularly those pertaining to criminal offences. As Malaysia navigates through these legal intricacies, transparency and clarity remain paramount to fostering public trust and understanding in the legal system's functioning and its impact on society.

Moreover, the Federal Court's decision is likely to spark further discussions and debates within legal and religious circles regarding the scope and boundaries of Islamic law in Malaysia. It raises questions about the balance between religious principles and constitutional rights, as well as the role of the judiciary in safeguarding individual liberties while upholding religious norms. These deliberations are crucial for shaping the future direction of Malaysia's legal framework and its commitment to principles of justice, equality, and pluralism.
