Kota Kinabalu: An unemployed man was charged in the Magistrate’s Court here Wednesday with assaulting his wife.

Azuan Romy, 29, pleaded not guilty before Magistrate Lovely Natasha Charles to voluntarily causing hurt to his 28-year-old wife on Aug 1 at 8.30pm, Kg Lembising, Putatan.

He was charged under Section 323 of the Penal Code read together with Section 326A of the same Code.

Section 323 carries a jail term of up to a year or a fine of up to RM2,000 or both on conviction while Section 326A states that whoever causes hurt to his spouse or former spouse, child, disabled adult, or other family members and commits an offence under Section 323, 324, 325, 326, 334 or 335 shall be punished with imprisonment for a term of twice as long as the maximum term for which he would be liable to on conviction for that offence.

Duty counsel Carmen Khoo, representing Azuan, requested a lower bail amount.

Lovely set Sept 23 for case management and released Azuan on a bail of RM2,000 in two sureties and granted the condition to the bail applied by the prosecution.

Meanwhile, a 27-year-old trader claimed trial to attacking his mother, two months ago.

Chu Rong Sheng, who appeared before Magistrate Stephanie Sherron Abbie, is alleged to have voluntarily caused hurt to Chua Chee Pin, 55, on June 16, at 8.45pm at a hotel in Donggongon.

The charge under Section 323 of the Penal Code carries a jail term of up to one year or with a fine of up to RM2,000 or both, on conviction.

The prosecution proposed bail at RM5,000 in two sureties.

Stephanie fixed Sept 26 for case management and offered the accused, who was represented by counsel Datuk Ram Singh, bail of RM1,000 in one surety.
