Kota Kinabalu: A 34-year-old man was charged with raping an underaged girl.

Fendey Sitah pleaded not guilty before Sessions Court Judge Azreena Aziz, Friday.

He is accused of raping the 15-year-old girl at 4.50pm on Oct 28, 2022 at a room in Jalan Bundusan Villa, Penampang.

The offence under Section 376(1) of the Penal Code carries a jail term of up to 20 years, and whipping, on conviction.

Read more The court released Fendey on a bail of RM10,000 with RM5,000 deposited in two local sureties with permanent address and job.

Fendey was also ordered to report to the nearest police station and warned not to tamper with the prosecution witnesses, including the alleged victim.

The court also ordered Fendey to surrender his passport, if any, to the court pending the disposal of his case.

The court set July 10 for case management to serve documents and hearing would be from Feb 22 -23, next year.

In another case, an illegal immigrant was jailed four months for entering the State illegally.

Mahadil Nuldin admitted to the charge against him.

He was arrested on May 13 this year at the city area after failing to produce his identification to police. The court ordered Mahadil to serve the jail sentence from the date of his arrest.

After completing his jail sentence, the court ordered Mahadil to be referred to the Immigration Department for his biometrics data to be recorded before deportation.
