TAWAU: A 25-year-old lorry driver was jailed 15 years and ordered given five strokes of the cane for raping his niece until she gave birth to a girl as a result.
Sessions Court Judge Rosli Ahmad handed down the sentence to the man who pleaded guilty,on Thursday.
The man had raped the 14-year-old victim between 2am and 3am in July and August, 2022 at a house in Bandar Sri Indah, here.
The offence under Section 376(2(d) of the Penal Code carries a jail term of between 10 and 30 years, and whipping, on conviction. The court ordered the man to serve the jail sentence from the date of his arrest on March 15 this year.

However, Deputy Public Prosecutor, Mohd Suhaimi Suriana urged the court to impose a heavy sentence and to take into account public interest in addition to the seriousness of the case.
Mohd Suhaimi said severe punishment should be imposed as a lesson to the man who has blood relationship with the victim.
He added that the trauma experienced by the victim after being raped many times until she gave birth should also be taken into account.
Mohd Suhaimi further submitted that the man did not show any remorse or regret for his actions when he was given the opportunity to mitigate.
Based on the facts of the case, on March 13 at 3.45pm, the victim was taken to the hospital by her grandmother after complaining of abdominal pain and upon checking by a doctor, she was found to be 36 weeks pregnant before giving birth at 7.15pm the same day.
The victim later revealed that she was raped by the man who lived next door to her grandmother’s house.
Following a police report, the man was arrested on March 15.
