Man jailed 7 months for knife threat on woman

Kota Kinabalu: A 46-year-old man was sentenced to seven months jail by the Magistrate’s Court for threatening to injure a woman with a knife.

Kaparin Tunsin pleaded guilty before Magistrate Dzul Elmy Yunus to committing the offence against one Nur Aina Risman using the weapon on Aug 2, this year, at 11pm, in Kg Air, here.

The charge was framed under Section 506 of the Penal Code which carries a jail term of up to seven years or fine or both on conviction.

The court was informed by the prosecution that on the said day, the complainant was attending customers at the open space in the said area, when suddenly a man, later identified as Kaparin, came and splashed her and the customers with water.

The complainant asked Kaparin to stop, but instead he took a knife out of his pocket and threatened to stab her.

Fearing for her safety, the complainant contacted the police, who later came and apprehended Kaparin and seized the knife from him.

Unrepresented, Kaparin requested a lenient sentence from the date of his arrest, saying that he was not in a normal state at that time, as he was intoxicated.

Prosecuting officer Inspector Alia Nuurlysa Adnan, applied a deterrent sentence.

Dzul ordered the sentence to run from the date of Kaparin’s arrest.

In another case, an entertainment premises manager was fined RM5,500 or eight months jail for operating the premises without a licence.

Md Shah Arifin admitted before Magistrate Marilyn Kelvin to committing the offence at the Pub and Karaoke premises in Lintas Square on Sept 14, this year, at 9.35am.

The charge under Section 4 of the PEO 1958 and punishable under Section 11 of the same Ordinance provides a fine of up to RM50,000 or up to one year jail or both on conviction.

The prosecution informed the court that police raided the premises and found it in operation without a valid business licence, which had expired on June 30 this year, among other breaches.

Unrepresented, Shah requested a reduced fine, stating that the business was not doing well.

Inspector Yusdi Basri prosecuting, applied a deterrent sentence.

Meanwhile, a single mother of three was jailed one month for shoplifting.

Hanisa Parman pleaded guilty to stealing four bottles of personal care products including face moisturiser, all worth RM166, from a Watsons branch in 1Borneo Hypermall near here on July 26, this year, at 11.55pm.

Hanisa’s whose case came up for mention Wednesday, changed her plea to guilty to the charge under Section 380 of the Penal Code.

The court heard from the prosecution that outlet staff noticed two women, one of whom was later identified as Hanisa, stealing from the rack.

A review of the CCTV footage showed her taking the items and walking out without paying.

Duty counsel Lim Ming Zoong @ Lawrence, representing Hanisa, requested leniency, saying that she is a single mother of three.

The court ordered Hanisa to serve the sentence from the date of her arrest, and for the exhibits to be returned to its owner.
