Man jailed and fined for misappropriation of property

Kota Kinabalu: A self-employed man was on Wednesday jailed eight months and fined RM4,000 or another four months for misappropriation of property two years ago.

Norhasikin Laji, 36, pleaded not guilty before Magistrate Jessica Ombou Kakayun to dishonestly keeping RM3,500 cash belonging to Safuan Willie Sodoi for his own use at 2.42pm on Oct 27, 2021 at Inanam Taipan, here.

The charge under Section 403 of the Penal Code carries a jail term of between six months and five years and whipping and liability of a fine, on conviction.

In presenting the facts of the case, prosecuting officer Albert Basiri, informed the court that the complainant saw an advertisement on the sale of a used Toyota Hilux while browsing the Facebook marketplace in September 2021 and contacted the handphone number provided and agreed to make the purchase.

The complainant felt cheated when he did not receive the vehicle and Norhasikin failed to be contacted, prompting the complainant to lodge a police report for further action.

Duty counsel Lim Ming Zoong @ Lawrence representing Norhasikin requested a lenient sentence.

In another case, a 41-year-old waiter was charged with trafficking 374.91gm of 3,4-Methylenedioxymethamphetamine (MDMA).

Woo Chee Ken was accused of committing the offence between 12.20am and 2am on April 8, this year at Pavillion Bundusan, Penampang.

However, no plea was taken from Woo after the charge was read out to him.

The charge under Section 39B(1)(a) of the Dangerous Drugs Act 1952, carries a punishment of either the death penalty or life in prison and whipping with a minimum of 15 strokes, on conviction.

The prosecution applied for a new mention date pending the chemist report and objected bail as the charge has no provision for such.

The court fixed May 5 for mention and ordered Woo to be further remanded.

Meanwhile, a car rental shop worker was charged with two counts of burglary and having stolen items.

Mohd Shameer Marican Ariffin pleaded not guilty to breaking into the Keda Sup Ikan Kudat at Lintas Jaya Uptownship here at 7.32am on April 3 this year along with an accomplice still at large and stealing an Ipad and a piggy bank belonging to Sitti Nazwahayati Alhabsi.

On the second count, Shameer denied having a stolen car computer box belonging to Habib Idrus Habib Mohammad at 8.55pm on July 15, 2020 at Taman Seri Gaya here.

The first count is framed under Section 457 of the Penal Code while the second count is under Section 411 of the same Code.

The prosecution proposed bail at RM5,000 and RM3,000 for the first and second count, respectively.

Duty counsel Carmen Khoo applied for a lower bail as the accused is married with three children.

The court released the accused on a bail of RM2,500 in two sureties on the first count and fixed May 15 for mention and offered him bail of RM1,500 in two sureties on the second count pending mention on May 25.
