KOTA KINABALU: A 37-year-old man was jailed seven months and given two strokes of the cane after pleading guilty to two counts of misappropriating RM17,240.75 belonging to 7-Eleven Sdn Bhd.
Mohd Saiful Azrie Tamjudin entered his guilty pleas before Magistrate Marilyn Kelvin over the offences committed at the company’s UUS Telipok and Sierra Bizhub outlets on Sept 25 this year.
The first charge involved RM16,484.90, while the second involved RM755.85.
Both offences were framed under Section 403 of the Penal Code, which provides for imprisonment of between six months and five years, whipping and a fine upon conviction.
Presenting the facts of the case, prosecuting officer Yusdi Basri told the court that an internal investigation found that sales proceeds totalling RM16,475.25 from the UUS Telipok outlet for Sept 24 and 25 had not been deposited.
At the Bandar Sierra outlet, a further RM478.25 in sales proceeds and RM650 in cash float were found to be missing.
The company subsequently lodged a police report, and investigations found that Mohd Saiful had dishonestly misappropriated the funds for his personal use.
Unrepresented in court, Mohd Saiful broke down in tears while appealing for a lenient sentence.
He said he regretted his actions and was now unemployed. He also told the court that he was the sole breadwinner for his wife, who suffers from kidney disease, and their four children.
He added that his elderly parents were unwell and depended on him.
Mohd Saiful further appealed for leniency, saying it was his first offence and promising not to repeat it.
However, Yusdi urged the court to impose a deterrent sentence for the offences.
