Man jailed for assaulting girlfriend

Kota Kinabalu: A 35-year-old man, who assaulted his girlfriend last year, was sent to prison for six months and fined RM1,000 or two months in jail by the Magistrate’s Court here Monday.

Clement Choon Ket Shiung, who works in online marketing, pleaded guilty before Magistrate Stephanie Sherron Abbie to causing hurt to the 36-year-old woman at 9.30pm on Sept 14, 2022 in front of the Servay Hypermarket, Putatan.

The charge under Section 323 of the Penal Code carries a jail term of up to one year or fine of up to RM2,000 or both on conviction.

Earlier, the court was informed by the prosecution that an argument ensued between the couple prior to the incident when the woman asked Choon to send her home as she was scared when Choon drove the car at high speed after drinking alcohol.

When in front of the hypermarket, the victim pulled the car’s handbrake causing Choon to get angry and punched her in the mouth and repeatedly punched the back of her head, said the prosecution.

Choon sped off and stopped the car suddenly causing the victim’s head to hit the dashboard of the car, said the prosecution, adding that the woman woke up in the parking lot of Choon’s house and was later sent home by his uncle.

The victim suffered injuries in the mouth and back due to the assault, the court heard.

Unrepresented, Choon requested leniency while the prosecution applied for an adequate sentence.

The magistrate ordered him to serve the jail sentence from Monday.

In another case, an Indonesian labourer was sentenced to 12 months’ jail and fined RM2,000 or two months’ jail for stealing a vehicle.

An undocumented, Marcel Jangak, 33, pleaded guilty to stealing an Isuzu D-Max belonging to one Prismus Emas at 5.40am on Dec 5, 2022 at Keliangau Shell kiosk, Manggatal.

The charge under Section 379A of the Penal Code carries a jail term of between one year and seven years and a fine on conviction.

The prosecution told the court that on the said day, Marcel entered the car at

the fuel pump area while the complainant was away at the payment counter and left his vehicle with the engine still running.

Marcel drove the car out of the kiosk but the complainant managed to catch up and got into the car and pulled out the vehicle key to turn off the engine.

Marcel was detained with the help of kiosk workers and handed to the police.

Unrepresented, Marcel requested leniency.

The court ordered Marcel to be referred to the Immigration Department after serving the sentence.
