
In a disturbing incident that shook a community, 34-year-old Rasip Astali has been sentenced to five months in jail and fined RM4,000, with a default option of seven months in prison. The sentencing comes after Rasip pleaded guilty to a reprehensible act—masturbating while watching a woman breastfeed her child. The incident occurred on August 13, 2022, at 10:40 am in the car park in front of a clinic at Inanam Terminal.
Rasip Astali appeared before Magistrate Lovely Natasha Charles and admitted to insulting the modesty of a 25-year-old woman, an offense falling under Section 509 of the Penal Code. This section carries a maximum penalty of up to five years in jail or a fine, or both, upon conviction.
The unsettling incident unfolded when the young mother, having just exited the clinic, settled in the front passenger seat to breastfeed her child. Unbeknownst to her, Rasip Astali, parked adjacent to her car, engaged in the lewd act of masturbation while staring at her.
Upon realizing that he had been caught in the act, Rasip hastily raised his car window and drove away, leaving the traumatized woman to grapple with the shock of the incident. However, she demonstrated resilience by quickly capturing a photo of Rasip's vehicle and promptly informing her husband about the distressing encounter.
Later that evening, a police report was filed, leading to Rasip Astali's arrest. The victim positively identified him during an identification parade on October 31.
During the hearing, Rasip was represented by National Legal Aid Foundation (YBGK) lawyer Carmen Khoo, who appealed for leniency. Khoo highlighted that Rasip, a lorry driver and the sole breadwinner for his family, was married with two children aged two and four. She emphasized his remorsefulness as a factor for consideration.
Inspector Kelvan Elson Maik, however, urged the court to impose a deterrent sentence, taking into account the public interest and the severe trauma inflicted upon the victim. He emphasized the gravity of Rasip's actions, stating that such behavior not only humiliates women but also disgraces men for engaging in such acts in public spaces.
Maik argued that the incident was not merely an isolated act of disrespect but could potentially lead to other criminal offenses, underscoring the need for a stern response to safeguard public decency.
As the court deliberated on an appropriate sentence, the case serves as a stark reminder of the importance of upholding respect and decency in public spaces, with legal consequences reflecting the severity of such disturbing transgressions. The ruling sends a clear message about the societal boundaries that must be upheld, promoting a safe and respectful environment for all.
