Kota Kinabalu: A 61-year-old man was jailed 16 months by the Magistrate’s Court for attempting to steal a car.
Jamil Zaini pleaded guilty before Magistrate Marilyn Kelvin to attempting to steal a Perodua Axia belonging to one Sumano Marman in front of Kinabalu Golf Club, Jalan Setesen Seacom, Tanjung Aru, at about 6.35pm on June 24.
The offence, under Section 379A of the Penal Code read together with Section 511 of the same Code, carries a jail term of between one and seven years and may also be punished with a fine.
For an attempted offence, the imprisonment term cannot exceed half of the maximum term prescribed for the offence.
The court heard from the prosecution that the complainant, who was on duty as a security guard at the location, detained Jamil after finding him at the driver’s seat of the complainant’s Perodua Axia.
The complainant told police that he had observed Jamil for about 15 minutes, during which he tried to open several locked vehicles before managing to open the complainant’s car.
Police then arrested Jamil following a report lodged over the incident.
The court ordered Jamil to serve the sentence from the date of his arrest.
In a separate case, two owners of an entertainment outlet were each fined RM4,000, or seven months’ jail for operating a public entertainment outlet without a valid licence.
Febronia June Fidelis, 29, and Ruben Nadarajah, 44, pleaded guilty to jointly committing the offence at La Bonika Latin Bistro, in Sri Kepayan Commercial Centre at about 10.40pm on June 6.
The offence under Section 3 of the Public Entertainment Ordinance 1958, punishable under Section 11 of the same Ordinance read together with Section 34 of the Penal Code, carries a fine of up to RM50,000, imprisonment of up to one year, or both, on conviction.
The facts of the case stated that a police team raided the premises and found it operating without a valid licence.
Further investigations established that both Febronia and Ruben were the owners of the premises and that it had no business licence registered with Kota Kinabalu City Hall’s Licensing Department.
