
Kota Kinabalu: A 36-year-old man charged with raping his niece, will go trial on Oct 21 – 23 this year.
Sessions Court Judge Amir Shah Amir Hassan set the date for the man who maintained his plea of not guilty during the case management on Friday.
During the proceedings, the prosecution served all the relevant documents to the man that would be used during the hearing.
The man is accused of raping the 13-year-old girl at 11.30pm in January, 2024 inside a lorry along the road from a village to another village in Tuaran.
He was charged under Section 376(1) of the Penal Code which carries a jail term of up to 20 years and whipping, on conviction.
The man was ordered remanded further pending the disposal of his case.
The court advised the man to engage a counsel to represent him during the trial.
Deputy Public Prosecutor Mohamad Shahril appeared for the prosecution while the man was not represented.
