
Kuala Lumpur: Miss Asia Malaysia 2023 winner Luwe Xin Hui can proceed with enforcing a High Court order for a RM1.48 million condominium or its cash equivalent after the pageant organiser’s stay application was rejected, New Straits Times reported.
High Court judge Datuk Arik Sanusi Yeop Johari dismissed Asia Television Digital Media (Malaysia) Sdn Bhd’s application, saying Luwe should not have to wait longer for the prize promised after her 2023 win.
The court had on Jan 29 ordered the company to transfer a unit at Picasso Residence, Jalan Ampang, worth RM1.48 million, to Luwe, together with vacant possession and the keys.
If the transfer could not be completed, the company was ordered to pay her RM1.48 million in cash, besides bearing the relevant costs, stamp duty and legal expenses.
Arik said the company’s concerns over the transfer process and recovering the money if its appeal succeeded did not constitute special circumstances to justify a stay.
