SANDAKAN: The Sessions Court here on Thursday sentenced a 45-year-old man to 10 years in jail and five strokes of the cane for sexually assaulting a six-year-old, who had been a passenger in his car hired for school transport.
Judge Zaini Fishir @ Fisal handed down the sentence to the man who pleaded guilty to committing the offence in his vehicle between noon and 1pm on July 29, this year.
The victim, who had no relation with the man other than being a passenger in his school transport service, later complained of pain and told her parents about the incident on the night of Aug 4.
The parents immediately took the victim for a medical examination after being told what had happened.
A police report was lodged, leading to the man’s arrest on Aug 5.
Investigators also recovered a video recording of the assault, which showed the incident taking place inside his car.
The man was charged under Section 14(a) of the Sexual Offences Against Children Act 2017, punishable under Section 14 of the same Act.
Upon completing his jail term, the man was ordered to be placed under two years of police supervision and required to undergo counselling while serving his sentence.
Deputy Public Prosecutor Muhammad Al-Hakim Abdul Razak prosecuted. The man was unrepresented.
