
Kota Kinabalu: A 59-year-old man was on Friday sentenced to a total of 36 months’ jail by the Magistrate’s Court on two counts of molesting a woman.
Magistrate Marilyn Kelvin, delivering her ruling at the end of the defence in Zulkarnain Abdul Ghani’s case, found him guilty of both offences.
AdvertisementOn the first count, Zulkarnain was jailed 18 months for groping the woman’s breasts, thighs and private parts on Nov 10, 2018, between 4pm and 6pm in a Toyota Vios car at Jalan Lintas.
Zulkarnain, on the second count, was handed another 18 months’ jail for groping the woman’s breasts, thighs, private parts and kissing her mouth on Feb 12, 2019 between 4pm and 6pm, in a Ford Ranger vehicle at Jalan Coastal here.

Marilyn ordered Zulkarnain, who was on bail, to serve the sentences concurrently from Friday. However, Zulkarnain managed to obtain a stay of execution of the sentence pending his appeal to the High Court.

Zulkarnain had on Sept 3, 2021 pleaded not guilty to the charges under Section 354 of the Penal Code and has since been released on a bail of RM1,800 in two sureties on each charge.
AdvertisementEach charge carries a jail term of up to 10 years or fine or with whipping or with any of such punishment on conviction. Six prosecution witnesses and two defence witnesses were called to testify throughout the trial.
Meanwhile, a 26-year-old man was charged with attempting to trespass into a house. Waynejohn Sylvester pleaded not guilty to committing the offence at a house occupied by one Faizal Samat in Batu 7, Jalan Tuaran,
Inanam by forcefully turning the door handle, on Feb 10, this year at 12.01am. The charge is framed under Section 448 of the Penal Code read with Section 511 of the same Act.
Marilyn fixed March 24 for pre-trial case management and released accused on a bail of RM1,500 in two sureties.
