Molesting woman: Man gets two months’ jail

Kota Kinabalu: A 43-year-old man was sentenced to two months’ jail on Monday for molesting a woman at a shopping complex here.

Syfulbahry Siuneh pleaded guilty before Magistrate Lovely Natasha Charles to committing the offence to a 29-year-old woman at 12noon on April 29 at the City Parade, Centre Point Complex here.

The prosecution earlier informed the court that a report from the Hospital Mesra Bukit Padang had been obtained, which stated that Syfulbahry was fit to enter a plea.

On May 9, Syfulbahry was referred to the said hospital by the court for mental observation after he was seen unable to understand what the magistrate was saying to him.

The charge under Section 354 of the Penal Code provides for a jail term of up to 10 years, or with fine or with whipping or with any two of such punishments, on conviction.

Inspector Kelvan Elson Maik, prosecuting, in tendering the facts of the case said prior to the incident, the complainant was doing a duty round at the City Parade area when an unknown man suddenly touched her left thigh.

The man, later identified as Syfulbahry, then tried to escape but was arrested by the security guard and handed to police.

Unrepresented, Syfulbahry requested leniency saying that he had given a good cooperation to the police and was presently on medication from the Hospital Mesra.

Kelvan applied for an adequate sentence.

In another case, four people were penalised for committing drug-related offences.

Two of them Fatin Asri, 31, and Zaimey Muluk pleaded guilty to having 0.07gm and 0.17gm of syabu, respectively on April 19 and May 13 here.

Fatin was jailed 12 months while Zaimey was handed two months’ jail and fined RM2,400 or seven months’ jail.

They were charged under Section 12 (2) of the Dangerous Drugs Act 1952 which provides for a fine of up to RM100,000 or up to five years’ jail, or both, on conviction.

Meanwhile, Al-Franconiro Benard and Nelson Gikiri admitted to taking syabu.

Al-Franconiro was ordered to pay a fine of RM2,200 or seven months’ jail while Nelson was jailed seven months.

Taking drugs under Section 15(1) of the Dangerous Drugs Act provides for a fine of up to RM5,000 or up to two years jail on conviction.
