
Kota Kinabalu: Kota Belud Member of Parliament Isnaraissah Munirah Majilis has filed an emergency motion in Parliament under Standing Order 18(1) to debate the recent High Court ruling on Sabah’s 40 per cent revenue entitlement.
She said the Federal Government’s failure to honour Sabah’s constitutional right for nearly five decades was unlawful and went beyond its powers under the Federal Constitution.
Isnaraissah said she took the step as part of her duty to uphold the Constitution and to ensure accountability over what she described as a long-standing constitutional breach.
“As a Member of Parliament who has taken an oath to preserve, protect and defend the Federal Constitution, such unlawful and ultra vires actions must be debated and clarified by the government,” she said.
She called on MPs from all sides to support the motion, saying the issue is no longer about politics but about safeguarding the constitutional balance that underpins the federation.
“This is not political rhetoric but a constitutional fact that we must uphold to maintain national harmony,” she added.
Her motion came a day after the Kota Kinabalu High Court ruled that the Federal Government had acted unlawfully and beyond its constitutional powers by failing to fulfil Sabah’s 40 per cent entitlement of federal revenue derived from the state.
The court also nullified the 2022 special grant agreement between the Federal and state governments, describing it as unconstitutional and inconsistent with Articles 112C and 112D of the Federal Constitution. Both governments were ordered to review and agree on a new revenue formula within 180 days.
