
A senior officer from the Malaysian Anti-Corruption Commission (MACC) and a businessman are set to face trial after their attempt to get two RM640,000 bribery charges dropped was denied by the Attorney-General's Chambers (AGC).
Deputy Public Prosecutor Farah Ezlin Yusop Khan informed the Sessions Court that the representations submitted by Mohd Rasyidi Mohd Said, 44, and Mohd Hussein Mohd Nasir, 55, on July 1 were rejected by the AGC. Judge Suzana Hussin confirmed the trial dates for August 8 and 9, as previously scheduled.
This was the second time the duo sought a review of the charges against them, which are framed under Section 16(a)(A) of the MACC Act 2009. Such representations are typically made to request the withdrawal or reduction of charges.
Defence lawyer Ariff Azami Hussein is representing both accused.
On May 25 last year, Mohd Rasyidi, who served as the MACC’s investigation branch chief, and Mohd Hussein, known as "Datuk Roy," were charged with soliciting a RM400,000 bribe from Siti Dalena Berhan and her husband, Syed Farid Syed Ahmad Al Attas. The alleged solicitation occurred near Lorong Kurau in Bangsar between 9 pm and 11 pm on March 5. Additionally, they were charged with accepting a RM240,000 bribe from the same couple at a fast-food restaurant near Desa Sri Hartamas between 2 pm and 4 pm on March 6.
The money was reportedly intended to prevent the remand of Datuk Fakhri Yassin Mahiaddin, the eldest son of former Prime Minister and Bersatu president Tan Sri Muhyiddin Yassin, by the MACC.
Mohd Hussein faces an additional charge of soliciting RM2 million from the same couple to interfere in corruption charges against Bersatu Segambut deputy chief Adam Radlan Adam Muhammad. This offence allegedly took place near Kampung Melayu Kepong in February last year.
All charges are under Section 16(a)(A) of the MACC Act 2009 and carry penalties under Section 24 of the same act, which include up to 20 years in prison and a fine of not less than five times the amount of the bribe or RM10,000, whichever is higher, upon conviction.
