Kota Kinabalu: The Court of Appeal has fixed Nov 12 for case management via e-review to set the ruling date on the Federal Government’s appeal against parts of the High Court decision regarding Sabah’s 40 per cent revenue entitlement.
A three-judge appellate panel comprising Datuk Azhahari Kamal Ramli, Datuk Ahmad Kamal Md Shahid, and Datuk Amarjeet Singh Serjit Singh fixed the date after hearing submissions from all parties on Thursday.
Putrajaya is appealing against the ruling by High Court Judge Datuk Celestina Stuel Galid, which held that the Federal Government acted unlawfully and beyond its powers by failing to review and pay the 48-year entitlement from 1974 to 2021 under Article 112C and the 10th Schedule of the Federal Constitution.
The High Court order, granted on Oct 17, 2025 following a judicial review application by the Sabah Law Society (SLS), issued an order of mandamus directing the Federal Government to review the revenue entitlement within 90 days and reach an agreement with the State within 180 days.
On April 6 this year, the Court of Appeal granted the Federal Government a temporary stay on enforcement and negotiations within the 180-day timeline pending the outcome of the appeal against the High Court's findings, orders, and deadlines.
