Kota Kinabalu: The Sabah Law Society (SLS) maintains that constitutional provisions governing the state’s 40 per cent special grant entitlement carry binding duties that must be fulfilled, its president Datuk Mohamed Nazim Maduarin said on Thursday.
He stressed that the 1974 to 2021 "Lost Years" must be addressed through the process prescribed by the Federal Constitution, backed by effective remedies for the breaches established by the High Court.
Nazim noted that while the Federal Government is not appealing against the constitutional 40 per cent formula itself or the requirement for a review under Article 112D, its appeal challenges substantial High Court findings on the "Lost Years", the review mechanism, consequential relief, and court jurisdiction.
Earlier, the legal body appeared before the Court of Appeal here to oppose the Federal Government's appeal against parts of the 17 October 2025 High Court ruling.
After hearing submissions from all parties, the appellate court reserved judgment and set Nov 12 for case management via e-Review to set the decision date.
