
Kota Kinabalu: A 46-year-old man charged with raping his daughter, will have his case for further mention on Oct 27.
The Sessions Court set the date for the man when the prosecution tendered the outcome from Hospital Mesra in Bukit Padang on the man’s mental observation.
The court was informed that the report stated that the man is fit to stand trial.
During the proceedings, the man did not answer any questions from the court and appeared confused.
The prosecution told the court that they had served all relevant documents to the man and will call seven witnesses during the hearing.
On the mentioned date, the court also sought an update on the status of legal representation for the man.
The man is accused of raping the eight-year-old girl at 7pm on Nov 22, 2024 at a house in Sembulan, here.
The offence under Section 376(3) of the Penal Code carries a jail term of between eight and 30 years, and whipping at least 10 strokes of the cane, on conviction.
Pending the disposal of the case, the man was ordered remanded further.
Deputy’s Public Prosecutor (DPP) Bryan Francis appeared for the prosecution while the man was not represented.
