Poisoning daughter: Man is freed - because she can’t be located for the case

Kota Kinabalu: A man was given a discharge not amounting to an acquittal (DNAA) from a charge of abusing his daughter by giving her to drink a type of poison mixed with coffee.

Sessions Court Judge Azreena Aziz gave DNAA to the 51-year-old man when his case was supposed for trial on Wednesday.

Earlier, the prosecution informed the court that the complainant could not be located and the Assistant Investigating Officer of the case may not be available until July 2021.

The prosecution has no objection if the man was given DNAA since it was 2021’s case and it was not fair for the man come to court without any progress but the man must cooperate with the police as he might be re-charged anytime.

The man was accused of abusing his five-year-old daughter at noon on May 16, 2021 at a living room of a house in Kg Bundu, Kuala Penyu.

The offence under Section 31(1)(a) of the Child Act carries a fine of up to RM50,000, or a jail of up to 20 years, or both, on conviction.

The court ordered for the bail sum paid by the man, to be refunded.

In another case, a 34-year-old man was ordered to enter his defence on a charge of robbing a senior citizen.

Sessions Court Judge Elsie Primus made the order for Mohammad Sobrie Muali, after ruling that the prosecution had established a prima facie case against him on Wednesday.

The court set Apr 18 for Mohammad’s defence.

Mohammad is accused of robbing one Laina Houpin, 61, of RM2,200, a pair of gold earrings and a gold necklace

at 7.30pm on April 9, 2021 by the roadside in front of the La Dentista Dental Clinic

at Lorong Cyber City, in Tanjung Aru, here.

He allegedly committed the offence together with another accused Joseph Gude who pleaded guilty to the charge and sentenced accordingly.

The prosecution had called six witnesses during the hearing.

Deputy Public Prosecutor Mas Izzaty Lokman appeared for the prosecution.
