KUALA LUMPUR: The Prisons Department will comply with any court order on former prime minister Datuk Seri Najib Razak's house arrest.
Home Minister Datuk Seri Saifuddin Nasution Ismail said Najib had the right to seek a royal pardon, adding that under the Federal Constitution, the power to grant a pardon rests with His Majesty Sultan Ibrahim, King of Malaysia.
"The department's role is to implement any decision in accordance with established legal procedures.
"Following the payment (of the RM50mil fine) made yesterday, we referred the matter to the Attorney General, particularly because the order of discharge issued by the court registrar had created a slightly different interpretation from a legal standpoint.
"We sought the Attorney General's advice to obtain clarity on how the matter should be implemented," he told reporters after an event in Kulim, Kedah.
He added the department was bound by the Attorney General's legal advice as the government's legal adviser.
"All necessary steps had been taken to implement any decision, whether made by the Pardons Board or through court directives.
"The Attorney General had provided a legal opinion, which was subsequently met with a response from Najib's lawyers.
"Where there are differences in interpretation, as advised by the Attorney General, the best avenue is for the matter to be determined by the court.
"Whatever the decision, the Home Ministry, particularly the Prisons Department, will carry it out in accordance with the law," he said. -THE STAR
