Kota Kinabalu: The Sessions Court on Tuesday set May 21 to hear the case involving a 30-year-old man charged with raping a woman.

Judge Elsie Primus gave the date for Midrick Makales, whose case was brought up for mention to fix the trial date.

The court was also informed that Midrick’s father could not be located as in previous proceedings. The court ordered his family to make their appearance as the court wanted to know whether the family would engage a counsel to represent Midrick.

Midrick is accused of raping the 21-year-old woman at 11am on Jan 13, this year, at a rented room of a shop in Lorong Buah Duku, here.

The offence, under Section 376(1) of the Penal Code, carries a jail term of up to 20 years, and whipping, on conviction.

Deputy Public Prosecutor (DPP) Eugenie Meredith Gilbert stood in for DPP Nurul Shaferrah Mad Iskim while Midrick was not represented.
