
Kota Kinabalu: A 21-year-old man was jailed 12 years plus three strokes of the cane for raping his underaged cousin.
Sessions Court Judge Amir Shah Amir Hassan meted out the sentence to the man who pleaded guilty to the charge against him, on Tuesday.
The man had raped the 11-year and four-month-old girl at 4am on Apr 18, this year in the room of a house in Papar.
The offence under Section 376(2)(e) of the Penal Code carries a jail term of between 10 and 30 years, and whipping, on conviction.

However, Deputy Public Prosecutor Al Hakim urged the court to impose a heavy sentence on the grounds that the victim in the case was the man’s cousin.
He added that the man should be the person whom the victim trusted because they were staying together as family but he raped the victim.
The court ordered the man to serve the jail sentence from the date of his arrest on Apr 18 this year and to be placed under police supervision for two years after completing the jail sentence.
The court heard that the incident happened while the victim was sleeping when the man entered the room and raped her.
The victim tried to shout for help but the man covered her mouth.
The man was arrested after a police report was lodged.
