Raping girlfriend, 15: Youth sent to correctional school

Kota Kinabalu: An 18-year-old charged with two counts of raping an underaged girlfriend, was sent to the Henry Gurney correctional school for three years or until he reaches 21, whichever earlier.

Session Court Judge Amir Shah Amir Hassan made the order when his case was brought up for social report and sentencing.

The social report from the Welfare Department suggested that the teenager be sent to the correctional school.

The suggestion made under Section 91(1) (f) of the Children Act 2006.

Read more On the first count, the teenager raped the 15-year and five-month-old girl at 12.30pm on June 19, 2023 in a hut at a seaside in Papar.

On the second count, he committed the same offence against the same victim at 4am on Nov 13, 2023 at the same place.

The offence under Section 376(1) of the Penal Code carries a jail term of up to 20 years, and whipping, on conviction.

The court heard that the teenager went to the victim’s house and brought her to the seaside where the rape took place.

Deputy Public Prosecutor Nurul Shafeerah Mad Iskim appeared for the prosecution while the teenager was not represented.
