
Kota Kinabalu: A 41-year-old chef was sentenced to 14 years’ jail and ordered to be given three strokes of the cane for raping his ex-employee in a hotel room.
Sessions Court Judge Elsie Primus meted out the sentence to Beitohlee Justine, after ruling that the prosecution had proven its case beyond reasonable doubt against Beitohlee, Friday.
Beitohlee was found guilty of raping the 24-year-old woman between 8pm and 7am on Feb 18 to 20, 2019 at a hotel room in Luyang, here.
The offence, under Section 376 (1) of the Penal Code of the Penal Code, carries a jail term of up to 20 years and whipping, on conviction.
The court ordered Beitohlee to serve the jail sentence from the date of conviction on Friday and also to be placed under police supervision for two years after serving the jail sentence.
However, the court granted Beitohlee’s application to stay execution of the sentence but ordered him to pay another additional bail of RM10,000 pending the appeal against the sentence to the High Court.
Six prosecution and three defence witnesses were called during the hearing.
Deputy Public Prosecutor Mas Izzaty Lokman, conducted the prosecution while counsel Jul Hamri and Bartholomew Jinggulam defended Beitohlee.
Meanwhile, a 28-year-old man charged with raping an underaged girl, will know his fate on Nov 29 this year.
The court set the date for Shahreyan Syah Lagayu.
Shahreyan is accused of raping the 16-year-old girl in a car at the Likas Sport Complex, here, between 10pm and 11.59pm on Nov 10, 2019.
